Abstract

The matter of individual and collective ownership is clearly defined in Qur'an and Hadith. The Religious Scholars and Researchers of subcontinent, in the light of Qur'an and Hadith, admit the subject of both individual and collective ownership. A person can be an owner of movable or immovable property, consumables or factors of production. The government cannot snatch the personal property from a person. However, in the matter of collective property in which everyone has an equal share such as water in rivers and oceans and the fish in them, timber from forests etc. All these things can only become the personal property of someone if he/she works hard to get them. Otherwise, until the water and fish are in rivers and oceans, everyone is an equal owner of them. He/she who works hard to get them will become the owner of them. There are detailed opinions of scholars on this subject   which are given in this thesis.
